A dad accused of raping his two daughters has been cleared for a second time after medical tests showed he was impotent.
The Yemeni dad was charged with the attack following a complaint from his ex-wife during a custody battle, Abu Dhabi Appeal Court was told.The girls’ mother, an Emirati of Yemen origin, said her eldest daughter told her the father had beaten her up and raped her and her sibling several times when they were both below the age of 14.
Medical reports had revealed that the girls were sexually assaulted. But the father’s lawyer told the court that the girls might have had sex with other people as no DNA traces were found linking their father to the crime. A medical report also showed that the Yemeni father was impotent.
His lawyer also argued in the appeal court that if the girls had been raped, there was no way their mother would have waited until her eldest daughter graduated from high school and then informed authorities.
He said the man’s ex-wife had made false statements because she wanted to win custody of her two daughters. Abu Dhabi Appeal Court upheld an earlier Criminal Court ruling that acquitted the Yemeni father.
Prosecutors had then challenged that verdict, but the man was cleared.
